These Terms of Use ("Terms") apply to your access to and use of higvr.com (the "Site") and to purchases made through the Site. The Site is operated by HIGVR HONGKONG LIMITED ("HIGVR", "we", "us" or "our"). If you have questions, please contact service@higvr.com.
1. Acceptance of These Terms
By accessing the Site, creating an order, or purchasing a product from us, you agree to these Terms and the policies linked on the Site, including our Privacy Policy, Return Policy, Limited Warranty Policy, Shipping Policy, Order Cancellation & Custom Products Policy, and Safety Notice. If you do not agree, do not use the Site or place an order.
2. Eligibility and Lawful Use
You may use the Site only for lawful purposes and in compliance with laws applicable to you, your location, and the products you order. You must provide accurate, complete and current information when making a purchase or contacting us.
You are responsible for confirming that a product may lawfully be purchased, imported, possessed and used in your destination. This is particularly important for products with firearm-like or other restricted appearances.
3. Product Information and Availability
We aim to display product descriptions, images, compatibility information, pricing and availability accurately. Colors, appearance and fit may vary slightly because of displays, production updates or customer-selected configurations. Compatibility depends on your equipment, software, application and configuration.
We may correct errors, update information, limit quantities, discontinue products, or reject or cancel an order if information is inaccurate, a product is unavailable, we suspect fraud or unauthorized resale, or fulfilling the order would create a legal, safety, shipping or destination restriction.
If we discover a material pricing, description or configuration error before shipment, we may contact you to confirm purchase at the corrected terms or cancel the affected order and issue an applicable refund. If we cannot contact you using the information provided with your order, we may treat the affected order as cancelled.
4. Orders and Contract Formation
Submitting an order is an offer to purchase. An automated acknowledgement or payment-related message does not by itself mean that an order has been accepted unless it expressly confirms acceptance. An order is accepted when we confirm acceptance or begin fulfilling the order, subject to payment authorization and any required product or destination review. We may contact you to confirm product configuration, compatibility, delivery details or legal and shipping feasibility before fulfillment.
If we cancel an order before shipment because we cannot fulfill it, we will refund amounts paid for the cancelled product and any applicable original shipping charge for that cancelled shipment.
5. No Unauthorized Resale or False Authorization
Unless HIGVR expressly authorizes otherwise in writing, products purchased through the Site are not offered for unauthorized resale, distribution or representation as part of an authorized HIGVR sales channel. You must not claim or imply that you are an authorized HIGVR seller, distributor, partner or representative without our written authorization.
We may limit quantities, request additional verification, refuse orders or cancel unshipped orders where we reasonably suspect unauthorized resale, false authorization claims, fraud or other activity that may harm HIGVR, our customers or the integrity of our distribution channels.
6. Custom Products
Certain HIG Glove and HIG-M4 orders are custom products when their functions, configuration or intended application are confirmed with a customer before production or fulfillment. Custom products require full payment. We will communicate the expected fulfillment time and applicable product scope after confirming requirements.
A custom configuration is confirmed when you approve the final functions, configuration or intended application in writing, through checkout acknowledgement or through another written confirmation method we provide. Once a custom product order has been confirmed, it cannot be cancelled or returned because you changed your mind. This restriction does not affect remedies for a wrong item, damage in transit, or a confirmed defect covered by our Limited Warranty Policy or mandatory law. 7. Shipping and Restricted-Appearance Products
Orders currently ship from mainland China. We offer worldwide shipping where delivery is reasonably and legally available. Products with firearm-like or other special appearances may be restricted by destination laws, carrier rules, customs requirements or changes in international circumstances.
If we determine before shipment that a special-appearance product cannot be delivered to your destination, we may cancel the affected order, notify you by email and refund the amount paid for the cancelled product and its original shipping charge. See our Shipping Policy.
8. Prices, Payment, Taxes and Duties
Prices and available payment methods are displayed at checkout. Unless otherwise stated, the customer is responsible for import duties, customs charges, taxes, brokerage costs and other destination charges. Failure to pay destination charges may result in delay, return or disposal of a parcel, subject to carrier and customs procedures.
9. Returns and Warranty
Eligible non-custom products may be returned under our Return Policy. All products are subject to our Limited Warranty Policy. Worn skin-contact products are not eligible for change-of-mind return, subject to rights that cannot be excluded under applicable law.
10. Safety and Appropriate Use
You must use products only as intended and in accordance with instructions and safety notices. Haptic and wearable products should be discontinued if they cause pain, skin irritation, overheating or unusual discomfort. Products with a firearm-like appearance are VR accessories only, are not real weapons, and must not be displayed or carried in a manner that could reasonably cause them to be mistaken for real weapons. 11. Intellectual Property and Brand Protection
The Site and its content, including the HIGVR name, logos, product names, product images, graphics, text, manuals, video content, software, firmware, product designs and other materials, are owned by or licensed to HIGVR and are protected by applicable intellectual property laws.
You may use Site content only for personal, non-commercial evaluation and use of our products. Without our written permission, you must not reproduce, modify, distribute, sell, use for commercial promotion, remove rights notices from, or create derivative works from our content.
You must not use our brand, product imagery, designs or materials to sell counterfeit or misleading products, falsely claim to be an authorized seller or partner, imply endorsement by HIGVR, remove or alter serial numbers or authenticity identifiers, or copy, reverse engineer or modify software or firmware except where applicable law expressly allows it.
12. User Communications and Submitted Materials
If you send us feedback, reviews, photographs, videos or other material, you represent that you have the right to provide it and that it does not violate another person's rights. We will not publicly use identifiable customer media for marketing without permission or another valid legal basis.
13. Third-Party Links and Services
The Site may link to third-party websites or services. Third-party services are governed by their own terms and policies. We are not responsible for their content, availability or practices, except to the extent required by law.
14. Disclaimers and Limitation of Liability
To the fullest extent permitted by applicable law, the Site and its content are provided on an "as available" basis. We do not promise uninterrupted operation or that every product will be compatible with every third-party device, software version or application unless expressly stated in the applicable product description.
To the fullest extent permitted by applicable law, HIGVR will not be liable for indirect, incidental, special or consequential loss arising from use of the Site or products. Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited, including liability for fraud, wilful misconduct, or personal injury or death where applicable law does not permit exclusion.
15. Events Outside Our Reasonable Control
To the extent permitted by applicable law, HIGVR is not responsible for delay or failure to perform caused by events outside our reasonable control, including carrier disruption, customs action, import or export restrictions, sanctions, public emergency, natural disaster, fire, flood, war, civil disturbance, labor disruption, power or telecommunications outage, or material supply interruption. We will take reasonable steps to inform affected customers and provide any remedy required by applicable law or expressly stated in our policies.
16. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised "Last updated" date. The terms applicable to an order are those presented or otherwise applicable when the order is placed, unless a change is required by law or agreed with you.
